Simply Gascony Limited (company number 07632986) ("Agent") and also referred to in these booking terms and conditions ("Terms") as "we", "us" or "our", acts as agent for the owners of the properties featured on our website ("Properties") www.simply-gascony.co.uk ("Website").
Reference to "you" and "your" means the first named person on the booking form ("Primary Guest"). By making a booking with us the Primary Guest agrees on behalf of all persons detailed on the booking form ("Guests") that: i) he/she has read these Terms and has the authority to and agrees to be bound by them on behalf of the other Guests; ii) he/she is over 21 years of age and where booking a property that has age restrictions, he/she declares that all Guests are of the appropriate age.
A binding contract is made when we accept your completed booking form ("Booking Form") by sending you confirmation of your booking ("Booking Confirmation").
These Terms and the Booking Form detail the agreement between the Primary Guest and the owner of the property ("Owner") in respect of your holiday rental of the property set out in the Booking Form ("Holiday").
The price of the Holiday is as set out in the Booking Form ("Price").
HOW TO BOOK AND PAY FOR YOUR HOLIDAY
Once you have chosen a property please either call us on +44 (0)79 1069 0955 between 9am and 6pm or e-mail email@example.com to check that the property is available for the dates you have selected.
On confirmation of the property's availability we will send you a Booking Form setting out the Price, either by email or by post (as requested by you). Please complete and return the Booking Form to us. A deposit of 30% of the Price ("Deposit") is payable on booking. You can either return your Booking Form with a cheque made payable to Simply Gascony Limited for the Deposit amount or you can email a copy of the Booking Form to firstname.lastname@example.org and make an automatic transfer directly to our bank account whose details are as follows: HSBC, account name Simply Gascony Ltd, account number 01346865, sort code 40-09-29. (Please note that any bank transfer charges are payable by you.) By submitting the Booking Form you acknowledge that the Deposit is non-refundable. On receipt of the completed Booking Form and the Deposit and subject to the property remaining available you will receive a Booking Confirmation from us (either by email or post).
The balance of the Price minus the Deposit ("Balance"), together with a refundable Security Deposit (as defined below), must be paid no less than 9 weeks before departure. Failure to pay the Balance in full and on time means that we are entitled to treat your booking as cancelled by you. Dishonoured cheques will be treated as a cancellation of your booking.
If a property is booked less than 9 weeks before the start of your Holiday, then the full Price is due upon booking. Again, please note the cancellation charges at paragraph 4 below.
If you or any Guest causes any damage to the property or any item in it or on its premises, you will be required to pay for the loss and/or damage caused. We therefore require that a security deposit is paid by you at the same time as the Balance to cover such damage ("Security Deposit").
The amount of the Security Deposit differs for each property and it will be specified on the Booking Form
All charges for damages, breakages and any extra cleaning required if we consider that you have left the property in an unacceptable state will be deducted from the Security Deposit.
The Security Deposit will be refunded to you within 4 weeks of your return from Holiday less any charges for damages as applicable.
CANCELLATION BY YOU
1. Any cancellation by you must be made in writing and sent to Simply Gascony by post to: 138a High Street, Selsey, West Sussex, PO20 0QE or e-mail to email@example.com. Cancellation will take effect on the date we receive notification by you.
The following cancellation charges will apply if you cancel your Holiday: i) 9 weeks or more prior to the start date of your Holiday there will be no further charges, but you will forfeit the Deposit; or ii) less than 9 weeks prior to the start of your Holiday then Simply Gascony is entitled to retain the Balance including Deposit on behalf of the Owner.
CANCELLATION BY SIMPLY GASCONY OR THE OWNER
In the unlikely event that Simply Gascony or the Owner cancels your Holiday or we need to modify any booking, we will notify you as soon as possible. If Simply Gascony or the Owner cancels your Holiday you will be offered alternative holiday accommodation, or an option to cancel your Holiday and receive a full refund of all monies paid by you up to that date.
EVENTS OUTSIDE OUR CONTROL
Except as expressly set out in these Terms, Simply Gascony will not be liable to pay you or your Guests any compensation if your holiday is affected by any event which is beyond our reasonable control. These events include (but are not limited to) war, threat of war, terrorist activity and its consequences or the threat of such activity, civil commotion, riot, the act of any government or other national or local authority including port authorities, industrial action by third parties, natural or nuclear disaster, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunications networks. If such an event occurs we will notify you as soon as possible.
It is a condition of these Terms that all Guests specified on the Booking Form take out comprehensive travel insurance at the time of booking providing cover for the duration of your Holiday. This insurance must include travel, cover for personal belongings, personal liability, loss of life, personal injury and medical treatment. We are entitled to ask you to provide us with a copy of your insurance policy.
The maximum number of people accepted at the property is stated in the description, and some property Owners may limit the number of children. Only the Guests listed on the Booking Form may stay at the property, unless with our prior written agreement.
Unless otherwise stated, all property Prices include utilities, linen and towels. In low and mid season a heating charge may be added for some Properties. You will be advised of this at the time of booking and any additional charges will be set out in the Booking Form. Our Prices may change at any time, but Price changes will not affect your booking where you have received a Booking Confirmation.
If you have a complaint whilst staying at the property, please bring it to our attention immediately or in any event during your Holiday, so that we may take action to rectify the problem. If you fail to make any claims or complaints to Simply Gascony prior to your departure it may affect our ability to investigate complaints and impact the way it is handled.
OUR LIABILITY TO YOU
We act as agent for the property Owners and we have no direct control over the properties. Our total liability to you is limited to a maximum of the Price paid for your Holiday. We do not accept any liability for personal injury to you or any Guest or loss of or consequential loss or damage to your property, or for any other matters over which we have no control. Additionally, the Owners do not accept liability for personal injury to you or any Guest or loss of or consequential loss or damage to your property, or for any other matters over which they have no control. However, we do not exclude or limit in any way our liability for death or personal injury caused by either Simply Gascony's or the Owner's negligence.
You must keep the property and all furniture, fixtures and fittings in or on the property in the same condition as when you arrive and you shall leave the property in the same state of cleanliness and general order in which you found it. We reserve the right to deduct from the Security Deposit the cost of any extra cleaning or repairs if we, or the Owner, consider the property is left in an unacceptable state.
You are using the property and its facilities at your own risk. Children must be properly supervised at all times. If the property has a swimming pool it is your responsibility to ensure that the pool security system remains active at all times when not in use.
It is your responsibility to ensure that the Guests behave respectfully and decently.
It is your responsibility to make sure that the property is secure at all times.
PROPERTY DESCRIPTION AND FACILITIES
All property descriptions on the Website have been approved by the Owner and, to the best of our knowledge, are correct at the time of publication. Simply Gascony will not be held responsible for any inaccuracy, misinterpretation or dispute that may arise in this respect.
Neither do we accept responsibility for the failure of facilities at the property including supply of gas, water, electricity, swimming pool filtration systems, domestic or electrical equipment or internet access. Please tell us as soon as possible if you encounter a problem and we will make every effort to solve problems of this nature as soon as we are notified.
ARRIVING AND LEAVING
Unless otherwise arranged with the Owner or Simply Gascony, arrival times at the property are between 16.00 and 19.00 on the first day of your Holiday, and you must vacate by 10.00 am on the day of departure. Any Guests still at the property after 10.00 am on the last day of their Holiday without prior permission from the Owner or Simply Gascony, will be liable for extra charges.
Pets are not allowed at any of the properties, unless otherwise agreed in advance with the Owner or Simply Gascony.
Smoking is not permitted inside any of the properties.
Simply Gascony or the Owner shall be entitled to request that certain Guests or pets leave the property (as appropriate) immediately if:
i) there is a greater number of people present than the maximum capacity as stated on the Booking Form;
ii) a pet is present in the property during your Holiday without the prior agreement of the Owner or Simply Gascony;
ii) any activity is undertaken by a Guest which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance; or
iii) any Guest contravenes our non smoking policy.
We will use the personal information you provide to us to: i) process your payment for the Holiday and ii) inform you about Simply Gascony's offers and news. You may choose to stop receiving information from us by contacting us. We will not pass on your personal information to any third party.
We may transfer our rights and obligations under these Terms to another organisation and we will notify you if this happens. This will not affect your rights under these Terms. It is agreed that you, Simply Gascony and the Owner may in their own right enforce the provisions of these Terms in accordance with the Contracts (Rights of Third Parties) Act 1999 (the "Act") which shall apply to these Terms. A person who is not a party to these Terms has no right under the Act to enforce them.
These conditions and the booking to which they apply are governed in all respects by English law. You and Simply Gascony both agree to submit to the exclusive jurisdiction of the English courts.
